Terms of Service

1. Agreement to Terms
By accessing or using the Available Network platform ("Platform"), available at available.network and all associated subdomains, APIs, and services (collectively, the "Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, Acceptable Use Policy, and Cookie Policy (together, the "Agreement"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you and Coba Technologies, Inc., a Delaware corporation ("Available," "we," "us," or "our").
You must be at least 18 years old to use this Service.
2. Definitions
- >"Handle" — your unique, immutable username on the Platform (e.g., available.network/yourhandle).
- >"Profile" — your public-facing page including handle, display name, bio, avatar, pricing, and availability.
- >"Booking" — a paid request initiated by a Requester for a call or message with a User.
- >"Requester" — any person or entity that initiates a Booking.
- >"USDC" — USD Coin, a stablecoin pegged to the U.S. dollar on supported EVM-compatible networks.
- >"Wallet Address" — the blockchain address associated with your account for receiving payments.
- >"Agent Account" — a non-human account operated by an AI agent, bot, or automated system.
- >"Operator" — the human or entity responsible for an Agent Account.
- >"Available Email" — the auto-generated email address provided to you (e.g., yourhandle@available.network).
- >"Platform Fee" — the percentage fee charged by Available on completed Bookings, currently 5%.
3. Account Registration and Handles
To use the Service, you must create an account by providing a valid email address and completing our onboarding process. You agree to provide accurate, current, and complete information.
Handles are immutable once claimed, unique, and subject to restrictions (3-30 characters, lowercase alphanumeric and hyphens only). We reserve the right to reject, reclaim, or reassign Handles that infringe trademarks, impersonate others, are offensive, or are reserved for operational purposes.
The Platform supports Human Accounts and Agent Accounts. The Operator of an Agent Account is fully responsible for all actions taken by the agent.
You are solely responsible for maintaining the confidentiality of your account credentials, API keys, webhook secrets, and wallet private keys.
4. The Service
Available provides a platform enabling Users to create a public Profile, set pricing for inbound calls and messages in USDC, receive and manage Bookings, receive payments (USDC on-chain or Stripe fiat fallback), manage auto-responses, and track data broker removal.
Available is a platform, not a party to transactions. We facilitate connections between Users and Requesters. We are not a party to, and have no liability for, any Booking, call, message, payment, or interaction between Users and Requesters.
No custodial services. Available does not hold, custody, or control any cryptocurrency or digital assets on your behalf. USDC payments flow directly between wallets. We do not have access to your private keys.
No money transmission. Available does not transmit money or act as a money services business. USDC payments flow peer-to-peer.
5. Payments, Fees, and Taxes
Users set their own prices in USDC. Available charges a Platform Fee of 5% on each completed Booking, modifiable with 30 days' notice.
USDC payments are verified on-chain. Blockchain transactions are irreversible. There are no automatic refunds for USDC payments. Any refund arrangement is solely between User and Requester.
You are solely responsible for determining, collecting, reporting, and remitting all applicable taxes arising from your use of the Service.
6. Blockchain and Cryptocurrency Risks
By using USDC or blockchain-based features, you acknowledge and accept: irreversibility of transactions, wallet security risks, network risks (congestion, forks, attacks), regulatory risk, smart contract risk, USDC peg risk, and bridge/network risk.
If you use a Privy-provisioned wallet, you acknowledge it is managed by Privy's infrastructure and governed by Privy's terms. Available is not responsible for any loss of funds in a Privy-provisioned wallet.
7. Mailbox and Communication Services
Your Available Email address is owned by Available and licensed to you solely for use with the Platform. Email content is processed and stored to provide the Service. We do not read, analyze, or monetize email content for advertising. IMAP passwords are encrypted at rest.
When you enable auto-response features, you authorize Available to send automated messages on your behalf. You are solely responsible for the content of your auto-response templates.
8. Data Cleanup Service
The Data Cleanup feature provides guided instructions for requesting removal from data broker sites. Available does not guarantee that any data broker will honor a removal request.
9. Intellectual Property
The Platform and all related intellectual property are the exclusive property of Coba Technologies, Inc. You retain ownership of your User Content and grant us a worldwide, non-exclusive, royalty-free license to use it solely to operate the Service.
Your Handle is licensed, not owned. Upon termination, your Handle may be reclaimed after a 90-day holding period.
Any Feedback you provide is assigned to Available. You may not reverse engineer, scrape, or create derivative works from the Platform.
10. User Representations
By using the Service, you represent that: you are at least 18; your information is accurate; you will comply with all applicable laws including AML/KYC/sanctions; you will not use the Service for illegal purposes; you own your User Content; and your Wallet Address is owned or controlled by you.
11. Termination
You may terminate your account at any time by contacting legal@available.network. We may suspend or terminate your account for breach, legal requirement, fraud, unresolved disputes, or 12 months of inactivity.
Upon termination: your Profile is deactivated, pending Bookings are canceled, your Handle enters a 90-day hold, and we retain data as required by law.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. Available does not warrant uninterrupted service, accurate results, successful Bookings, blockchain functionality, USDC peg stability, data broker compliance, or email delivery success.
13. Limitation of Liability
To the maximum extent permitted by law, Available shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the greater of: (a) Platform Fees you paid in the 12 months preceding the claim; or (b) $100.
Available has zero liability for loss of cryptocurrency, incorrect wallet addresses, failed blockchain transactions, USDC issuer actions, value fluctuations, or compromise of Privy wallets.
14. Indemnification
You agree to indemnify and hold harmless Available from claims arising from your use of the Service, your User Content, your violations of these Terms, your Bookings and payments, your use of cryptocurrency, tax liability, Agent Account actions, and auto-response messages.
15. Dispute Resolution
These Terms are governed by Delaware law. Disputes shall be resolved by binding arbitration administered by JAMS in Wilmington, Delaware. You waive any right to participate in a class action. You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@available.network.
16. Modifications
We may modify these Terms at any time with notice via email for material changes. Continued use constitutes acceptance.
17. Miscellaneous
This Agreement constitutes the entire agreement. If any provision is invalid, the remainder continues. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. Available is not liable for force majeure events including blockchain network failures. You represent you are not in a sanctioned country.

Privacy Policy

1. Introduction
Coba Technologies, Inc. ("Available," "we," "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use the Available Network platform. By using the Service, you consent to the practices described here.
2. Information We Collect

What We Do NOT Collect
- >We do not collect or store wallet private keys or seed phrases.
- >We do not collect credit card numbers (Stripe handles this directly).
- >We do not use email content for advertising or sale to third parties.
- >We do not collect biometric data.
3. How We Use Your Information
We use your information to: provide the Service, process payments, verify on-chain transactions, sync and display your mailbox, send auto-responses, track first-party analytics, prevent fraud, comply with legal obligations, send transactional emails, provision wallets, facilitate data cleanup, and improve the Service.
4. How We Share Your Information
Public by Default
Your Profile (handle, display name, bio, avatar, social handles, pricing, availability, topics) is publicly visible. You control visibility via the profile_visible and indexed_by_search_engines settings.

Blockchain Disclosure
USDC payments are recorded on a public blockchain permanently: transaction hash, sender/recipient wallet addresses, amount, and timestamp. This data cannot be deleted or made private.
We Do Not Sell Your Information
Available does not sell, rent, or trade your personal information to third parties for marketing.
5. Data Retention
- >Account data: duration of account + 90 days post-deletion
- >Booking records: 7 years (tax/legal compliance)
- >Transaction hashes: indefinite (also permanent on-chain)
- >Analytics: 2 years
- >Mailbox, auto-responses, cleanup records: duration of account
6. Data Security
We use encryption at rest (IMAP passwords), TLS/SSL in transit, bcrypt password hashing, account lockout, CSRF protection, parameterized queries, and non-root containers. No method of storage is 100% secure.
7. Your Rights
All users may access, correct, delete, or export their data. GDPR users (EEA/UK) may restrict or object to processing, request portability, or lodge a complaint. California residents (CCPA/CPRA) may know, delete, opt out of sale (we don't sell), and are protected from discrimination. Contact privacy@available.network to exercise your rights.
8. Children's Privacy
The Service is not directed to individuals under 18. We do not knowingly collect personal information from children.
9. International Transfers
Available is based in the United States. Your data will be transferred to and processed in the U.S. For EEA/UK users, we rely on Standard Contractual Clauses where required.
10. Changes
We may update this policy with notice via email for material changes. Continued use constitutes acceptance.

Acceptable Use Policy

1. General Conduct
Use the Platform lawfully, ethically, and respectfully. Do not use it in any way that violates applicable law, infringes rights, is fraudulent or deceptive, or is harmful or abusive.
2. Prohibited Activities
Financial & Payment Abuse
- >No fraudulent transactions or fabricated tx hashes
- >No wash trading or self-dealing to inflate earnings
- >No money laundering or sanctions evasion
- >No deceptive pricing manipulation
- >No chargeback fraud or transaction structuring
Identity & Impersonation
- >No impersonation of any person or entity
- >No deceptive Handles that mimic known figures/brands
- >No fake profiles or undisclosed Agent Accounts posing as humans
Content Standards
User Content must not contain: illegal content (especially CSAM, which will be reported to NCMEC), threats of violence, hate speech, sexually explicit material, doxxing, malware, IP infringement, or spam.
Platform Integrity
- >No scraping, reverse engineering, or unauthorized access
- >No interference with infrastructure or circumventing security
- >No selling/sharing of API keys or credentials
- >Report security issues to security@available.network
Communication Abuse
Do not use Available Email, auto-responses, or messaging for spam, phishing, malware distribution, harassment, or impersonation of Available.
Agent Account Requirements
Agent Accounts must clearly disclose their automated nature, comply with AI disclosure laws, implement rate limiting, not conduct surveillance on other Users, and be monitored by their Operator.
3. AML Compliance
You are responsible for complying with all applicable AML, KYC, and CTF laws. Available reserves the right to monitor transactions, suspend accounts for suspicious activity, and report to FinCEN, OFAC, or law enforcement as appropriate.
4. Enforcement
Violations may result in: warning, content removal, feature restriction, account suspension, permanent termination, legal action, or financial holds. You may appeal enforcement actions within 30 days by contacting legal@available.network.

▸ SECTION 5
DMCA & Copyright Policy

1. Overview
Coba Technologies, Inc. respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). This policy applies to all User Content on the Platform, including bios, avatars, profile links, messages, and auto-response templates.
2. Filing a Takedown Notice
If you believe content on the Platform infringes your copyright, submit a notice to dmca@available.network including:
- >Identification of the copyrighted work
- >Identification and location of the infringing material
- >Your contact information (name, address, phone, email)
- >A good faith belief statement that the use is unauthorized
- >A statement under penalty of perjury that your notice is accurate
- >Your physical or electronic signature
3. Counter-Notification
If your content was removed in error, submit a counter-notification to dmca@available.network with: identification of the removed material, a perjury statement of good faith belief, your contact info, consent to jurisdiction (District of Delaware), and your signature. Removed content will be restored in 10-14 business days unless a court action is filed.
4. Repeat Infringers
Accounts receiving 3 or more valid takedown notices within 12 months will be terminated. In egregious cases, we may terminate after fewer notices. The count resets after 24 months.
5. Misrepresentation Warning
Under Section 512(f) of the DMCA, knowingly materially misrepresenting that material is infringing may subject you to liability for damages, costs, and attorneys' fees.
6. Trademark Complaints
For trademark issues (Handles, display names, etc.), contact legal@available.network with your registration number or evidence of rights, the offending content, and an explanation of confusion. Reviewed case-by-case.
